Environment Australia has advised that the following Public Notification was required under the Commonwealth Environment Protection and Biodiversity Conservation Act 1999.

Australian Silicon Limited/Industry/Broulee/Wood Processing and Metallurgical Carbon Facility (Reference No. 2001/478).

The Commonwealth Minister for the Environment & Heritage decided on 16 November 2001 that:

"The proposed action to construct a wood processing and metallurgical carbon facility near Broulee on the south coast of NSW, ans as described in the referral received under section 75 of the Environmental Protection and BiodiversityAct 1999, is not a controlled action".

That means that a full assessment is not required.
