"MODIFICATION" - LOT LAYOUT ADJUSTMENT
304 Meringo Road, MERINGO DP 1029087, lot 25
Since sending our first submission on this matter (22 August
2007) we have been asked by several members to make these additional
comments -
- The history of the development clearly shows that Lot 23
was to be retained as one lot and regarded as open space or private
reserve (Advice received Jan 1989).
- The Assessment in Feb 1989 said the clustering concept was
proposed to conserve existing vegetation but concerns were expressed
regarding the subversion of the DCP. What is now proposed appears
to be trying to subvert the DCP.
- Approval was conditional on the creation of a suitable 88B
instrument on the title to all lots in relation to the fact that
no further subdivision of lots created in the proposal will be
approved.
- We argue that this proposal cannot be considered a retrospective
modification because the last stage of the subdivision was 18
years ago. Since then Council has recognized the environmental
constraints of the land in that area.
- Subdivision would presumably allow the construction of dwellings
on each lot and clearing for bush fire protection would significantly
degrade what was supposed to be a nature corridor set up as part
of the original subdivision.
- If the proposed subdivision was assessed as a new application
it would not meet the Rural Fire Service requirement that no
more than 4 lots can be accessed from a private road.
